In short, Bill 96 is intended to significantly overhaul and strengthen the Charter of the French Language in Qu\u00e9bec to further recognize French as the province\u2019s only official language. The Bill seeks to reinforce the use of French language in education, business, services, publications, and daily life. This insight will highlight key impacts Bill 96 may have on trademarks and advertising in Qu\u00e9bec.<\/p>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_65a261-58\"><div class=\"kt-block-spacer kt-block-spacer-halign-center\"><\/div><\/div>\n\n\n\n<h4 class=\"kt-adv-heading_d10c71-14 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading_d10c71-14\"><strong>POTENTIAL IMPACTS ON TRADEMARKS IN QU\u00c9BEC<\/strong><\/h4>\n\n\n\n<p>Currently, in Qu\u00e9bec, a \u201crecognized trademark\u201d (meaning a mark that is registered\/applied for in Canada, or a common law mark) that is not in French is exempt from translation requirements when displayed, as long as no French version of this mark has been registered. That means, for example, a registered or common law trademark, such as a company logo, can be displayed in English on a product\u2019s packaging sold in Qu\u00e9bec without being required to be translated into French.<\/p>\n\n\n\n<p>Bill 96 will significantly change the ability to use non-French trademarks on product labelling\/packaging in Qu\u00e9bec. Recent amendments to the Bill propose that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bill 96, would modify the current exemption for \u201crecognized trademarks\u201d by allowing only non-French trademarks&nbsp;<strong>registered<\/strong>&nbsp;within the meaning of the&nbsp;<em>Trademarks Act<\/em>&nbsp;(i.e., not common law marks or marks which are the subject matter of pending applications) to benefit from the exemption; and<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If a registered trademark benefitting from the Bill 96 exemption includes a \u201cgeneric term or description\u201d of the product (the scope of \u201cgeneric term or description\u201d has not been outlined), the term or description would have to be translated into French elsewhere on the product, with permanent visibility and readability.<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_01ce00-e5\"><div class=\"kt-block-spacer kt-block-spacer-halign-center\"><\/div><\/div>\n\n\n\n<h4 class=\"kt-adv-heading_6516ac-70 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading_6516ac-70\"><strong>POTENTIAL IMPACTS ON ADVERTISING IN QU\u00c9BEC<\/strong><\/h4>\n\n\n\n<p>Currently, Qu\u00e9bec\u2019s \u201crecognized trademark\u201d exception, allowing registered and common law marks to be in English (unless there is a French version registered), applies to commercial advertising, public signs, and product packaging\/labelling. However, even with this exception, French still has to have a \u201csufficient presence\u201d when advertising visibly outside a premise. A \u201csufficient presence\u201d means giving a prominent display to the French accompanying the mark.<\/p>\n\n\n\n<p>Notably, Bill 96 seeks to change the current&nbsp;<strong>\u201csufficient presence\u201d<\/strong>&nbsp;of French standard to a higher standard of a&nbsp;<strong>\u201cmarkedly predominant\u201d<\/strong>&nbsp;presence of French:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\">Afin de pouvoir afficher une marque de commerce dans une autre langue que le fran\u00e7ais dans une publicit\u00e9 commerciale ou de l\u2019affichage public, il faudra que la marque de commerce soit d\u00e9pos\u00e9e en vertu de la <em>Loi sur les marques de commerce<\/em> et que la marque n\u2019ait pas de version fran\u00e7aise correspondante (autrement dit, les marques de common law ne sont plus admissibles).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\">Le projet de loi 96 propose que dans l\u2019affichage visible de l\u2019ext\u00e9rieur d\u2019un commerce, le fran\u00e7ais soit <strong>nettement pr\u00e9dominant<\/strong> si la marque est dans une autre langue que le fran\u00e7ais.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bill 96 also proposes that on public signs and posters that are visible from outside a premise, French has to be&nbsp;<strong>markedly predominant<\/strong>&nbsp;if the advertising has the enterprise\u2019s name and includes an expression in a language other than French.<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_bace62-bd\"><div class=\"kt-block-spacer kt-block-spacer-halign-center\"><\/div><\/div>\n\n\n\n<h4 class=\"kt-adv-heading_754f85-e8 wp-block-kadence-advancedheading\" data-kb-block=\"kb-adv-heading_754f85-e8\"><strong>CE QUE VOUS DEVEZ RETENIR ET PROCHAINES \u00c9TAPES<\/strong><\/h4>\n\n\n\n<p>To prepare for the &nbsp;passage of Bill 96, businesses and persons who are using trademarks in Qu\u00e9bec in languages other than French should consider registering their marks on the Canadian Trademarks Register.
